My name is Salvatore D'Anna. In May of 2006, I had surgery for kidney cancer. Pacificare denied coverage for this surgery the day before it was scheduled. A few months later, instead of paying for the $65,000 surgery, Pacificare decided to cancel my policy by falsely claiming that I knew I had cancer before I applied for insurance. KTLA News interviewed me as part of their coverage of the DMHC public hearing on the illegal practice of "post-claims underwriting" in violation of California Health and Safety Code ยง 1389.3 on January 29, 2007.

My case against Pacificare is currently in The California Fourth Appellate District, Division One. After my arbitration hearing ended last December, I went to the office of one of my physicians to try and find out why her testimony was different from what had actually taken place. I discovered that she had been speaking with Pacificare's attorney whom she believed represented me in the case for several months and given him documents that he was not entitled to receive. I had her sign a declaration to that affect and presented it to the court as an ethics and HIPAA violation because Ex Parte communications are prohibited without my written consent. The trial court said that I submitted no evidence of fraud to vacate the arbitration award so now I am representing myself in my own appeal.
